GENERAL CONDITIONS 
The general conditions are an integral part of the rental agreement entered into between you and APIVEND 2000 S.L. with fiscal address at Avinguda De Rhode 64, Apartado de Correo no. 659, Postal Code 17480 in Roses (Girona) with CIF no. B-17.635.509.

1- CONDITIONS OF CONTRACT

Stays according to season.

The rates applied are exempt of VAT. The corresponding VAT will be applied to the supplements. 

The client must supply information and personal documents of all the occupants of the apartment (including children and babies) at the moment of formalization of the contract.

2- TRAVEL LOG
People staying in lodging establishments located in Catalonia, are obliged to register (Article 2 of the Order IRP/418/2010, of the 5th August, on the obligation of recording and reporting to the Directorate General of Police people staying in accommodation establishments located in Catalonia)

The national identity card or passport will be compulsory from the age of fourteen (Article 9.2 of the Organic Law 1/ 1992 of 21 February on the Protection of Public Safety)

All children must provide for registering their name, date of birth and nationality.

 3- TAX FOR STAYING IN TOURIST ACCOMMODATION ( IEET )

According to Law 5/2020 (DOCG num 8124 of 30.04.2020) a rate of 1,00 €/day per person (occupant) in each property will apply. A maximum amount corresponding to 7 night’s rates is established.

Individuals or occupants of less than or of 16 years of age are exempt from this tax (Art.108.1.b)

4 - PAYMENT METHODS
In order to confirm your reservation request, you must pay a deposit of 30% of the total reservation amount and the remainder must be paid according to the rental season. High Season: July and August.Low Season: rest of months.In the event that the payment for the pre-reservation is not received within 24/48 hours, the company reserves the right to cancel without notice.

*Before the key is handed over, the total payment of the reservation must have been made and paid into the account.

5- INCLUDED SERVICES AND RATES
Electricity, water, gas, community and management service and initial end cleaning.

Exit cleaning will be charged on all reservations and the amounts will depend on the type of property. In the final cleaning is not included and customers will be penalized for leaving trash in the accommodation, food, dishes or glasses to be washed or that the cleaning to be performed exceeds the estimated hours for the cost paid. In this case, a penalty of € 15 / hour will be applied for the extra time needed.


6- OPTIONAL SERVICES (TAXES NOT INCLUDED)

Pets: 50,00€/reservation (in the apartments where they are permitted)
* Pets are only allowed in those apartments where this is shown as being an optional service. Only one pet per accommodation is allowed and with a maximum weight of 16kg. The client is obliged to declare whether they are bringing any pets before their stay. Failure to comply with these measures can incur a fine of 500€ in accommodation where pets are allowed and where they are NOT allowed, the contract with the client may be cancelled. The client/owner of the pet is totally responsible for the actions, behaviour or destruction which their pet may incur to the occupied accommodation.

7- PERIODS
The rental period is specified in the conditions of each contract. The handing over of the keys will be carried out between 16:00 and 19:30 on the first day of rental period contracted. The arrival after office hours will have a penalty of 50€ to 150€. Except in the cases that have been communicated well in advance and APIVEND 2000 SL can organize the entrance with the automatic key collection system (after payment of the deposit). In any other case APIVEND 2000 S.L. reserves the right to cancel the reservation losing the tenant the payment on account made.

The departure will be made on the agreed day at 10:00 a.m., the client being responsible for depositing the keys of the accommodation in our offices and delivering the apartment in the same state in which he found it.


8- DEPOSIT
Upon handing over of the keys the tenant will be charged via a credit or debit card in favour of Apivend 2000 S.L. for the amount indicated as the security deposit. At the end of the contract the client agrees to deliver in the same condition in which they were found both, the accommodation, the furniture or its utensils, being responsible for all damage that may be caused during the rental as a result of their misuse, including those caused by pets. Otherwise, the amount for cleaning, repair or rectification of the damage involved will be deducted from the security deposit.
The charge will be made via previous authorization by credit card or debit card. 

8.1 Deposit refund
The deposit will be returned within 72 hours once the accommodation has been reviewed and is in perfect condition. If the return incurs an expense by bank commission, this will be assumed by the customer and will be deducted from the amount of the deposit deposited. 

9- PROMOTIONAL NOTES
The offers cannot be combined nor be applied to other promotions or to applied discounts.


10- COMMUNITY RULES
Accommodation integrated in a community of neighbours are governed by its internal regulations and/or community statutes. In the event of community facilities such as swimming pools, tennis courts, etc. these are not open throughout the year, the opening and closing dates depend on weather, demand, hygiene and other factors. Therefore APIVEND 2000 S.L. is not responsible for the closure of facilities within a community complex due to factors outside the management of rental broker, and at the same time the customer will be responsible for their safety in the use of them.

11- ABILITIES EXCLUDED
APIVEND 2000 S.L will not be responsible in the following cases:
1. Theft, loss or damage that may be incurred by clients during their stay in rented accommodation.
2. Cuts in the supply by the large companies such as electricity, water or gas.
3. Breakages of electrical appliances or other apparatus which forms part of the accommodation will be notified to APIVEND 2000 S.L. and they will report this to the Technical Service within 24 hours, but non-attendance by this service shall not be grounds for compensation by APIVEND 2000 S.L.
4. Works carried out by the councils or other companies outside the control of APIVEND 2000 S.L. can be done in the vicinity or within the buildings, which may affect the normal development of the client's stay.

 12- CANCELLATION OF THE CONTRACT
In the event of a cancellation the following be charged as a penalty:

·       High Season: 31 days or more before arrival date, Free Cancellation. (Not included bank fee).
·       Rest of Season: 6 days or more before the entry date, Free Cancellation (Not included bank fee).
·       Within a shorter period than the previous ones, no refunds will be made.
If the cancellation is due to illness or accident, and when duly supported by medical reports, the amount received will remain in favour of the tenant and can be used for another occupancy or transferred to a third party.
There will be no payment if the customer cancels the service voluntarily before completing their stay. In the event that once the customer has rented the accommodation, it could not be delivered, APIVEND 2000 S.L. undertakes to provide alternative accommodation of a similar standard or higher and if unable to satisfy the client, to refund the of money that has been paid to APIVEND 2000 S.L. for this brokerage management.


13- RESOLUTION OF THE CONTRACT
 APIVEND 2000 S.L. can cancel the contract automatically in the following events:  
1. When the accommodation is occupied by a superior amount of people than allowed. In this case, APIVEND 2000 S.L. can ask for the name and identity document of each of the extra occupants.
2.  When the client assigns or sublets all or part of the contracted accommodation causes the immediate evacuation of all the occupants.
3.  The modification of the location of the furniture in the accommodation.
4.  The carrying out of any activity that contradicts the municipal regulations and the uses of coexistence, hygiene and usual public order or which impedes the normal rest of other tenants in the property, complex or urbanization.

 14- PERSONAL DATA PROTECTION ACT (RGPD)
In accordance with what is established in the RGPD, we inform you that APIVEND 2000 SL is responsible for data processing, in order to carry out the management of client, tax and accounting requests. That the data comes from the interested party and that the legitimacy is based on the execution of a contract or the fulfillment of a legal obligation. Data transfers are planned to the Tax and Accounting Advisory, Public Registries, Banks and Savings Banks, Tax Administration.
